Knowshon Moreno facing DUI charge





DENVER -- Denver prosecutors say Broncos running back Knowshon Moreno has been charged with drunken driving and careless driving after getting pulled over in south Denver.

Denver district attorney's spokeswoman Lynn Kimbrough said Tuesday that Moreno is also charged with failure to have proof of insurance and is due back in court March 2 after police issued a summons.

Denver police Lt. Matthew Murray says Moreno was pulled over on Feb. 1 after allegedly driving 70 mph in an interstate construction zone where the speed limit was 45 mph.

According to FOX31 in Denver, Moreno was driving a Bentley convertible with personalized license plates that read "SAUCED."

"We take the incident involving Knowshon Moreno very seriously, and are thoroughly reviewing this matter," the Broncos said in a statement Monday. "Our organization will continue to gather information and closely monitor this issue while the legal process takes its course."

Moreno, the No. 12 overall pick of the 2009 draft, is currently rehabilitating a torn ACL he suffered during the 2011 season. Denver is expected to bring in a running back either early in the draft or in free agency. Moreno lost his starting job to Willis McGahee last season.

Moreno's best chance of sticking in Denver in 2012 likely is as a third-down back.

Matt Bush's bail more than $1 million

PUNTA GORDA, Fla. -- Tampa Bay Rays pitcher Matt Bush is being held on more than $1 million bail on charges that he left the scene of an accident that seriously injured a motorcyclist.

Bush made his first court appearance Saturday. Charlotte County Circuit Court records show that Bush remained in custody on multiple DUI-related charges and counts of leaving the scene of an injury accident and driving with a suspended license.

The Florida Highway Patrol said Bush kept driving after hitting a motorcycle Thursday. The motorcyclist remains hospitalized.

Bush's attorney, Russell Kirshy, said the baseball player would likely enter a rehab program once he gets released.

Kirshy said, "We hope and pray the victim is OK and we hope and pray we can get Matt back on track."

Bush's arraignment is set for May 21.

Justin Blackmon pleads not guilty


STILLWATER, Okla. -- An attorney for Jacksonville Jaguars first-round draft pick Justin Blackmon entered a not guilty plea to a misdemeanor count of driving under the influence.

The former Oklahoma State star appeared in an Oklahoma courtroom for the first time Monday since his weekend arrest for suspicion of drunken driving.

Blackmon was allowed to remain free on $1,000 bond.

Police arrested Blackmon during a traffic stop in Stillwater early Sunday after a breath test allegedly showed his blood alcohol content to be three times the legal limit.

Blackmon left the courtroom surrounded by friends. His attorney, Cheryl Ramsey, declined to comment.

The Jaguars selected Blackmon fifth overall in April's draft. A team spokesman said Sunday that the Jaguars are trying to learn more about the arrest and had no comment.

Marshawn Lynch charged with DUI


Seattle Seahawks running back Marshawn Lynch was charged Wednesday with driving under the influence by the district attorney's office in Alameda County, Calif.

Teresa Drenick, director of communications for the Alameda County DA, said in an email that the decision was made to charge the Seahawks' star running back. Lynch has a court date on Aug. 14.

But Lynch's attorney, Ivan Golde, told The Associated Press later Wednesday that he feels the case could get thrown out or reduced because of discrepancies in blood-alcohol tests.

In a phone interview, Golde said that Lynch was at .08, which is the California legal limit, during a preliminary alcohol screening when Lynch was pulled over in Emeryville, Calif., on Saturday. Golde said when Lynch was retested at the jail, he blew above a .08.

"We think we have a really strong case," Golde said.

Lynch was seen weaving on Interstate 880 in the Oakland, Calif., area on Saturday morning, leading to his arrest for investigation of DUI. An incident report released by the California Highway Patrol described Lynch driving a Ford Econoline van and having two near collisions with two other vehicles driving in adjacent lanes.

This is Lynch's first off-field problem since coming over to Seattle from Buffalo during the 2010 season. Lynch's career stalled with the Bills and was highlighted by two off-field brushes with the law, one of which resulted in a three-game suspension.

He pleaded guilty in March 2009 to a misdemeanor gun charge in Los Angeles. He was sentenced to 80 hours of community service and three years' probation, and was suspended three games by the league for violating the NFL personal conduct policy.

The league is aware of Lynch's latest legal trouble, but it's unclear whether his past transgressions could get lumped together with his current DUI arrest and lead to yet another suspension.

Lynch signed a four-year contract in March that will keep him in a Seattle uniform for the prime of his NFL career. The contract is worth $31 million, including a guaranteed $18 million. Lynch rushed for 1,204 yards and 12 touchdowns last season.

Aldon Smith suspected of DUI





San Francisco 49ers All-Pro linebacker Aldon Smith was released from jail Friday after his pickup truck apparently struck a tree and he was arrested on suspicion of driving under the influence and marijuana possession, authorities said.

Smith later took to the practice field with his teammates Friday afternoon at team headquarters in Santa Clara. He is scheduled to appear in court on Nov. 4.

Smith declined to comment when reporters asked about his arrest.

Coach Jim Harbaugh told reporters Friday that he expects that Smith will play Sunday when the Niners host the Indianapolis Colts at Candlestick Park.

"I expect Aldon -- like today -- he'll be back to work and playing on Sunday," Harbaugh said. "I anticipate that, yes."

Harbaugh said that any potential discipline will likely come from the NFL.

"There will be consequences. There always is," Harbaugh said. "Good or bad, we all have consequences."

Smith, 23, posted $5,250 bail and was released from the Santa Clara County jail late Friday morning, just hours after he was taken into custody by police responding to a single-vehicle crash that involved his truck in San Jose, Santa Clara County Sheriff's Sgt. Kurtis Stenderup said.

San Jose police arrested Smith after officers received a call from a resident about the crash in the city's Silver Creek area around 7 a.m., Sgt. Heather Randol said.

Officers gave Smith breath tests and other tests after his pickup apparently struck a tree, hit a curb and left streak marks on a driveway and sidewalk.

"They conducted an investigation and determined he was under the influence," Randol said about Smith. "He was the only person inside the vehicle."

The linebacker, who helped the 49ers get to the Super Bowl last season, has 37 sacks in 34 career games and was selected to his first Pro Bowl and was an All-Pro last season.

Smith won the team's MVP award last season as he set the Niners' franchise record with 19½ sacks. A first-round draft pick out of Missouri in 2011, Smith also set the team's rookie sack record with 14 that year.

His teammate, Pro Bowl tight end Vernon Davis, said Friday that Smith's arrest caught him by surprise as the team constantly talks about staying out of trouble.

"Some guys listen, some guys don't. You can take the horse to the water, but you can't make him drink. It's all about doing the right thing," Davis said. "I'm sure he'll come around. It's just a matter of time. Hopefully, he'll learn from this situation that he got himself into, and maybe it will come out positive instead of negative."

Smith, who turns 24 on Wednesday, has had other issues with the law as he was also arrested on suspicion of drunken driving in Miami Beach in January 2012.

In addition, he's named in a lawsuit by a Northern California man who said he was shot during a party at Smith's house.

In the suit filed earlier this month in Santa Clara County Superior Court, David Kleczek, an attorney for Ronndale Esporlas, claims that Smith and former 49ers tight end Delanie Walker fired weapons illegally during a party at Smith's San Jose home on June 29, 2012.

The players charged a $10 admission and $5 per drink, the lawsuit said. Smith and Walker, who is also named in the suit, were allegedly intoxicated on Smith's balcony when they later fired gunshots in the air while trying to end the party, the lawsuit said.

Kleczek said they then moved to the driveway where he alleged more shots were fired. Esporlas, 21, was shot twice in the leg while he was "caught in the crossfire between the two groups of people firing gunshots at each other," the lawsuit said.

As a result, Esporlas, "sustained serious, catastrophic and permanent injuries," the lawsuit said. The lawsuit seeks unspecified damages.

Attorneys for Smith and Walker, 29, who currently plays for the Tennessee Titans, have said Esporlas "freely and voluntarily exposed himself to all risks of harm" by attending the party.

They say injuries suffered by Esporlas, who was shot in the leg, were not caused by the defendants.

Santa Clara County prosecutors have said they are considering criminal charges.
